EULA - End User License Agreement

PRODUCT LICENSE AGREEMENT FOR DOTS SOFTWARE-PRODUCTS

The term "Product" includes dots software-products in trade and related documentation, and any upgrades, modified versions, updates, additions, and copies thereof.

IMPORTANT - READ CAREFULLY
YOU SHOULD CAREFULLY READ THE FOLLOWING TERMS AND CONDITIONS. IF YOU DO NOT AGREE WITH THESE TERMS AND CONDITIONS, DO NOT INSTALL THE PRODUCT AND RETURN THIS ENTIRE PACKAGE PROMPTLY AND YOUR MONEY WILL BE REFUNDED.
This product is licensed solely for your internal use. You may use the product on a single machine. Provided the product is configured for client-/server use you may use the product on a single network server and on several client workstations simultaneously. The number of workstations is based upon the number of acquired client licenses. You may make one copy of the software itself for backup purposes, provided that all proprietary notices are reproduced on such backup copy.

DISASSEMBLY, DECOMPILATION, DECRYPTING AND OTHER REVERSE ENGINEERING OF THE PRODUCT IS STRICTLY PROHIBITED.
If permitted in the documentation, you may incorporate all or part of the product on other software or documentation, in which case such other software or documentation must contain all proprietary notices.

YOU MAY NOT USE, COPY OR TRANSFER THE PRODUCT OR ANY COPY, EXCEPT AS EXPRESSLY PERMITTED BY THIS LICENSE. IF YOU DO SO, YOUR LICENSE IS AUTOMATICALLY TERMINATED.
YOU AGREE THAT YOU NEITHER OWN NOR HEREBY ACQUIRE ANY CLAIM OR RIGHT OF OWNERSHIP TO THE SOFTWARE AND RELATED DOCUMENTATION OR TO ANY RELATED INTELLECTUAL PROPERTY.

Not for Resale Software. If the SOFTWARE PRODUCT is labeled "Not for Resale" or "NFR" or "Evaluation Copy" or "Demo Version", then, notwithstanding other sections of this EULA, you may not use the SOFTWARE PRODUCT for commercial purposes nor sell, or otherwise transfer it for value.

TERM
This license is effective until terminated. You may terminate it at any other time by destroying the product and backup copy. This license will also terminate upon conditions set forth elsewhere in this Agreement or if you fail to comply with any term or condition. Upon such termination you agree to destroy the product and all copies.

LIMITED WARRANTY
dots warrants only
a) that the media on which the product is furnished will be free from defects in materials and workmanship under normal use for a period of 90 days from the date of delivery to you and
b) that the product will operate substantially as described in the user manual during that 90 day period.

YOU MUST ASSUME FULL RESPONSIBILITY FOR THE SELECTION OF THE PRODUCT TO ACHIEVE YOUR INTENDED PURPOSES, FOR THE PROPER INSTALLATION AND USE OF THE PRODUCT AND FOR VERIFYING THE RESULTS OBTAINED FROM USE OF THE PRODUCT. DOTS DOES NOT WARRANT THAT THE FUNCTIONS CONTAINED IN THE PRODUCT WILL MEET YOUR REQUIREMENTS, THAT THE PRODUCT IS FIT FOR ANY PARTICULAR PURPOSE OR THAT THE OPERATION OF THE PROGRAM WILL BE UNINTERRUPTED, ERROR FREE OR VIRUS FREE.

Should you discover a defect in the recording medium or an error in the product within the 90 day warranty period, then return the defective item to where you obtained it. Include a copy of your receipt or other proof that the warranty period has not expired. Upon verification of the defect or error, the defective item will be either repaired or replaced.
IN NO EVENT WILL DOTS OR DOTS SUPPLIERS BE LIABLE TO YOU FOR ANY LOST PROFITS, LOST SAVINGS OR OTHER INCIDENTAL, INDIRECT, SPECIAL OR CONSEQUENTIAL DAMAGES, ARISING OUT OF YOUR USE OR INABILITY TO USE THE PRODUCT OR THE BREACH OF ANY EXPRESS OR IMPLIED WARRANTY EVEN IF DOTS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
THIS LIMITED WARRANTY IS IN LIEU OF ALL OTHER WARRANTIES, WHETHER ORAL OR WRITTEN, ANY IMPLIED WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE EXPRESSLY EXCLUDED.
GENERAL

In the event the Federal Acquisition Regulations ("FAR") or DFARS is applicable to this Agreement, the product is commercial computer software and provided only with the rights specified in this Agreement. You are responsible for paying any sales or use tax imposed at any time whatsoever on the license of the product.
YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT, UNDERSTAND IT AND AGREE TO BE BOUND BY ITS TERMS AND CONDITIONS. YOU FURTHER AGREE THAT IT IS THE COMPLETE AND EXCLUSIVE STATEMENT OF THE AGREEMENT BETWEEN YOU AND DOTS RELATING TO THE USE OF THE PROGRAM.
This license agreement shall be governed and interpreted in accordance with the laws of Germany.

THIRD PARTY RIGHTS
DOTS SUPPLIERS ARE INTENDED THIRD PARTY BENEFICIARIES AND ARE ENTITLED TO ENFORCE IT IN THEIR OWN NAME DIRECTLY AGAINST THE END USER.
